The people at Waco tried to create a "state" without a jurisdiction. I was trying to get them to use a different procedure. There were a lot of patriot belief systems involved that were not properly applied. The people who were trying to defend them became involved in raising money instead of litigation content. They were trying to raise money for a criminal defense when no criminal action had been filed. The needed to claim the "privilege of the Writ of Habeas Corpus".
Almost all of your belief systems have a basis in law. The problem is "applying" these beliefs in a way that the federal judges will recognize. This is called a "basis in law" for your claim. The people at Waco were not trying to apply the Preamble....they had a different belief....I would say that they would have needed a "Biblical" jurisdiction (which is allowable under the Constitution). However they did not want to do this. They refused to do it. When you have a "leader" that is unwilling to sit in a courtroom and be judged by his peers...you do not have a republic. The Constitution will only allow you to form a republican form of government. You cannot create a dictatorship. Somewhere you have to apply Amendment Seven and rules 37 (in the United States) and 38(not within the United States) of the federal rules of civil procedure.
